Terms and Conditions

The terms that govern the use of Madrid Now, explained clearly and without small print. Read them before using the website.

1. Purpose

These Terms and Conditions govern access to and use of the website Madrid Now, available at www.madridnow.es (the "Website"), owned and operated by Gianluca Marletta (the "Owner"). The Website is an informational platform that publishes and aggregates information about events, culture and activities in Madrid, together with editorial content. Access to the Website is free of charge.

2. Acceptance

Accessing, browsing or using the Website grants the status of user (the "User") and implies full and unreserved acceptance of these Terms & Conditions and of the Legal Notice, the Privacy Policy and the Cookie Policy. This acceptance has the same validity and effect as a signed contract. If you do not agree with these terms, please do not use the Website.

3. Conditions of use and User obligations

The User undertakes to use the Website and its content lawfully, in good faith and in accordance with these terms, public order and accepted standards of conduct. In particular, the User shall not:

  • use the Website for unlawful purposes or in any way that may damage, disable, overburden or impair it, or interfere with other users' use of it;
  • attempt to access restricted areas, systems or data without authorisation;
  • introduce viruses or any other harmful code;
  • extract, reproduce, reuse or exploit the Website's content in a manner not permitted by these terms or by law, including systematic or automated scraping, in particular for the creation of a competing service.

The Owner may deny or withdraw access to the Website, without prior notice, to any User who breaches these terms, and reserves the right to pursue any civil or criminal action that may correspond to it by law.

4. Event information

Event information published on the Website (including dates, times, prices, locations and availability) is obtained from third parties such as organisers, venues and public listings. The Owner does not guarantee its accuracy, completeness, reliability or currency and accepts no liability for changes, cancellations, errors or omissions. Users must verify all details directly with the organiser before attending or making any arrangements. Any dealings or contracts the User enters into with organisers, venues, advertisers or other third parties found through the Website are exclusively between the User and that third party; the Owner is not a party to them and assumes no responsibility for them.

5. Intellectual and industrial property

All original content of the Website — including its design, structure, source code, texts, graphics, logos, trademarks and other distinctive signs — belongs to the Owner or is used under the appropriate authorisation, and is protected by Spanish and international intellectual and industrial property law.

No licence or right over this content is granted to the User beyond what is strictly necessary to use the Website. Partial reproduction of the Website's editorial texts is permitted only where the content's integrity is preserved, Madrid Now (www.madridnow.es) is cited as the source, and the use is non-commercial. Any other use requires the Owner's prior written authorisation.

Some photographs and media displayed on the Website are used under free third-party licences (such as Unsplash, Pexels and Pixabay); the corresponding rights remain with their respective authors under those licences.

6. Links

The Website may include links to third-party websites, provided for informational convenience only. The Owner does not control and assumes no responsibility for the content, lawfulness, availability, accuracy or practices of those sites, nor for any damage arising from their use, and the existence of a link does not imply any relationship with or endorsement of the linked site. Conditions applicable to links pointing to this Website are set out in the Legal Notice.

7. Sponsored content and advertising

Where the Website includes advertising or sponsored content, it will be presented so that it can be distinguished from editorial content. Advertisers and sponsors are solely responsible for ensuring that their material complies with applicable law, and the Owner is not responsible for any error, inaccuracy or irregularity in such material or for the User's dealings with advertisers.

8. Newsletter

Users may subscribe to the Website's newsletter by providing their email address and giving their express, informed consent. Consent may be withdrawn at any time, free of charge, using the unsubscribe link in each message or by writing to info@madridnow.es. The processing of subscription data, including the email service provider used and any international transfers, is described in the Privacy Policy.

9. Minors

The Website is not directed at children under 14 years of age. Users under that age must not subscribe to the newsletter or provide any personal data without the prior consent of a parent or guardian, in accordance with applicable data protection law. Where a User is a minor, a parent, guardian or legal representative must authorise the use of the Website beforehand and shall be responsible for the minor's use of it.

10. Disclaimer of warranties and liability

The Owner does not guarantee that the Website will be available without interruption or free of errors or harmful components. To the fullest extent permitted by law, the Owner excludes any liability for damage of any kind arising from: the use of or inability to use the Website; errors or omissions in its content; reliance on event or other information published on it; or the acts of third parties, including organisers, advertisers and operators of linked sites.

The User agrees to hold the Owner harmless against any damage or third-party claim arising from the User's breach of these terms or unlawful or improper use of the Website.

11. Notice and takedown

If you become aware of any content on the Website that is unlawful, infringes intellectual property rights, or affects your image or other rights, please notify the Owner at info@madridnow.es. The Owner will review the notice and, where appropriate, remove the content promptly.

12. Modifications

The Owner may modify these Terms and Conditions at any time. The version published on the Website at the time of access applies, and continued use after changes are published implies acceptance of the updated terms.

13. Severability

If any provision of these Terms and Conditions is declared null or unenforceable, the remaining provisions shall remain in force and shall be interpreted in accordance with the parties' intention and the purpose of these terms.

14. Language

These Terms and Conditions may be provided in several languages. Where a Spanish-language version exists, it shall prevail in case of any discrepancy, as Spanish law governs these terms.

15. Applicable law and jurisdiction

These Terms and Conditions are governed by Spanish law. For the resolution of any dispute, the parties submit to the Courts and Tribunals of the city of Madrid (Spain), without prejudice to any mandatory protections applicable to Users qualifying as consumers, who may bring claims before, and rely on the law of, the courts of their own domicile.
